Here are a few tips that will reduce the likelihood that you’ll get a ticket and what to do
if you are pulled over by a police officer.
Keep in mind that you want to make a good impression (under the circumstances) with
the officer. He/she has the will and citation book and your job is to give him a lot of
reasons to let you off with a warning.
If, the officer does give you a ticket, and you plan on fighting the ticket, do not
antagonize the officer and try to ruin his/her day as well. Why, you ask? You want the
officer to have no “axe to grind”, to make sure you get “nailed” with a dmv point and
fine because you were so awfully upset at him.
Stay cool, and as calm as you can…you can scream and yell AFTER he’s left the
scene. Your job is to start preparing for trial immediately. Gather evidence about the
scene, take photographs. You must write up the whole event AS SOON AS POSSIBLE
WHILE IT’S FRESH IN YOUR MIND.
Go to my website and fill out the ticket evaluation form immediately. You can contact
me and ask for additional trial preparatory steps to take.
Now, here are some things to remember to do.
1. WHEN PULLED OVER BY A POLICE OFFICER, DO NOT REACH INTO YOUR
GLOVE COMPARTMENTTO GET YOUR PROOF OF INSURANCE AND
REGISTRATION. ASK THE OFFICER FOR PERMISSION TO YOUR DOCUMENTS
IN THE GLOVE COMPARTMENT. THE POLICE OFFICER WILL APPRECIATE YOUR
ASKING BEFORE YOU REACH INTO THE COMPARTMENT.
2. BE COURTEOUS. BE UNDERSTANDING. BE REASONABLE. DON’T GIVE THE
OFFICER A BAD TIME WITH A PERSONAL ATTACK. He actually thinks he’s doing
his job. Do not give him very good reasons to want to appear in court to make sure you
get convicted. You want someone he forgets quickly…and has no good reason to go to
court if he can possibly get out of it.
3.IF ASKED “Do you know why I pulled you over?” Say “No I don’t. I was just
driving safely along” BE NICE! (You’re trying to avoid getting issued a ticket!)
4. TO AVOID GETTING PULLED OVER, ALWAYS AVOID LEADING THE PACK.
ALWAYS DRIVE 2 MPH LESS THAN THE FLOW OF TRAFFIC.
5. IF THE POLICE OFFICER WRITES YOU UP, ALWAYS ASK TO HAVE THE CASE
HEARD AT THE COUNTY SEAT, AND MAKE SURE THE OFFICER OR YOU WRITES
“COUNTY SEAT PLEASE” ON THE TICKET.
6.REMEMBER THAT DRIVING WITH THE FLOW OF TRAFFIC IS NOT A DEFENSE
TO EXCEEDING THE POSTED OR STATE MAXIMUM SPEED.
7.IMMEDIATELY AFTER GETTING THE TICKET, PULL OVER AND WRITE UP ALL
THE FACTS. DRIVE BACK OVER THE COURSE WITH A DIGITAL CAMERA AND
TAKE LOTS OF PHOTOS OF THE COURSE. HAVE THE FILM DEVELOPED ON A
CD FOR TRIAL USE, OR USE A DIGITAL CAMERA AND UPLOAD THE PHOTOS
ONTO YOUR COMPUTER FOR LATER TRIAL USE.

9. CUT OUT THE BUSINESS CARDS THAT APPEAR HERE. KEEP ONE IN YOUR

11.IF YOU HAVE A DMV POINT PROBLEM, DO NOT USE THE TRIAL BY
DECLARATION THAT IS OFFERED BY THE COURT. THE CHANCES ARE THAT
YOU WILL BE FOUND GUILTY AND WHILE YOU CAN HAVE A NEW TRIAL IN
COURT EVEN IF YOU LOSE, THE POINT WILL ALREADY APPEAR ON YOUR
DMV DRIVING RECORD. THE POINT WILL STAY ON YOUR RECORD UNLESS
AND UNTIL THE CASE IN WON AT THE NEW TRIAL (DE NOVO)..
